About this policy

The protection of your personal data is of great importance to Toshiba Tec (Thailand) Co., Ltd. (“Company”, “we”, “our” or “us”). This privacy policy (the “Privacy Policy”) intends to inform
you about how we, as data controller, collects and processes your personal data that you give or disclose to us. We also act as data controller when we process your personal data received or
obtained through third parties. This Privacy Policy applies to all persons who may have come into contact with the Company, this includes employees, job candidates, our clients, and site visitors. What is personal data?
Under Thailand’s Personal Data Protect Act of 2019 (“PDPA”) Personal Data refers to any information relating to a natural person, which can identify such person directly or indirectly, but
excluding the data of a deceased person.

How do we collect your Personal Data?
We may collect Personal Data directly or indirectly from:

  • you (i.e., when you fill in forms displayed on the Website);
  • cookies or other electronic communication terminal equipment or your Internet browsers;
  • our business partners or other entities in our group; and
  • government bodies or other organizations.

What kind of your Personal Data do we collect and hold?
The Personal Data we collect, and hold will vary depending on what we require to perform our functions and responsibilities. In all cases, we will ensure that your personal data we process are
adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed. It may include:

  • information about your identity (e.g. name, surname, ID photo, date of birth, details of identification card, passport information and official identification card and driver’s license)
  • name, address and contact details (e.g. phone, email, fax number and other information which may be available on your business card)
  • information about your personal circumstances (e.g. age, gender, marital status educational history, working experience and occupation (mostly applicable to job candidates and employees))
  • information about your criminal records
  • your health data, if required (most applicable to job candidates, employees and service providers)
  • information about your financial affairs (e.g. payment details, bank account details, and information about business and financial interests);
  • information about your satisfaction on our products and services;
  • certain information about your hardware and software including, your IP address, browser type, operating system, access times and referring website address;
  • video or photographic records of your physical features when you enter the Company’s premise and your vehicle registration plate number under the same scenario.

How long will your Personal Data be held?
We will retain your Personal Data for as long as it is necessary or relevant for our business purpose, but not exceeding [10 years] after our last service provided to you or when your employment relationship with you is terminated. We may, however, store your information longer than that if required by law.

How do we use and disclose your Personal Data?
We will use or disclose your Personal Data for the following purposes:

  • to carry out our direct or indirect obligation arising from any contracts;
  • to provide you with the information, products and services that you request from us (e.g. sale transaction, after-sale service and warranty claim);
  • to notify you about changes to our service;
  • to ensure that content from our website is presented in the most effective manner for you and for your computer;
  • to process recruitment in case where you apply a job with us;
  • to process the periodical health checking as provided in your employee benefit plan (applicable to job candidates or employees only);

within the relevant exceptions under PDPA.

To whom might your Personal Data be disclosed to?

We will take reasonable steps to protect your Personal Data against unauthorized disclosure. Subject to the provisions of the applicable laws, your Personal Data may be disclosed, for the purpose listed above, to the following entities or parties:

  • Any member of our group including our subsidiaries, related corporations and affiliates and with our ultimate holding company and its subsidiaries;
  • Business partners and suppliers;
  • Sub-contractors, if they are required;
  • Advertisers and advertising networks;
  • Prospective seller or buyer of any business or assets;
  • Our professional advisers such as consultants, auditors and lawyers;
  • Entities providing insurance and warranty services, asset management company, banks, company providing housing loans;
  • Hospitals, in case of employees, that we retain for periodical health checking;
  • Outsource service providers, for example, providers of employee payroll services or agencies that the company has retained for purpose of arranging business trips for employees
  • Public and governmental authorities; and
  • Any other party to whom you authorize us to disclose your Personal Data.

How do we disclose your Personal Data to overseas recipients?
Should your Personal Data be transferred out of Thailand, we will pay special attention to how your Personal Data is proceeded, we will only provide your Personal Data to an overseas recipient
if we are legally allowed to do so under PDPA or other applicable laws. For each of these transfers, we will make sure that we provide an adequate level of protection to the data transferred.

How do we assure quality of your Personal Data?
PDPA requires us to take reasonable steps to ensure that the Personal Data we hold is safe and secure. We are also required to take reasonable steps to ensure that the Personal Data that we
collect is accurate, up-to-date, and complete. This may include correcting your Personal Data where it is appropriate to do so.

How do we secure your Personal Data?
We aim to protect your Personal Data from loss, unauthorized access, use, modification or disclosure, and against other misuse. If a data breach occurs, such as when Personal Data that we hold is subject to unauthorized loss, use or disclosure, we will respond in line with PDPA. Our response may include making notifications to the supervisory authorities and communications to the affected data subjects, which might include you. We will aim to provide timely advice to you to ensure you are able to manage any data breach which is considered high risk that may affect your rights or freedom (e.g. financial loss or otherwise that could result from the breach). When it is necessary to provide your Personal Data to a third party, we will take appropriate step to ensure that the third party will protect your Personal Data from loss, unauthorized access, use, modification or disclosure, and against other misuse.

What is your control over your Personal Data?
We understand your concern over your control regarding your Personal Data. Under certain
circumstances, you have the right to:

  • Rectify your Personal Data;

We will respond to your complaint or request in a timely manner if you provide your contact details. We take all complaints seriously and are committed to a quick and fair resolution. We
will not take the fact that you have made a complaint into consideration when we perform any of our other functions or activities. We will not charge you any fees in dealing with your request regarding your Personal Data under this Data Privacy Policy. However, there may be a charge involved for us to process a request under PDPA that goes beyond a request regarding your Personal Data.
